1. Who we are and who this policy applies to
The IZING ecosystem is operated by NEXT4U CORP, based in Port Richey, Florida, United States, and comprises IZING Atendimento and IZING Agente IA. This policy explains the processing of personal data on the websites, in sales inquiries, when entering into a contract, and when using these services.
For privacy matters and requests concerning personal data, email [email protected]. For sales and contractual matters, use [email protected].
NEXT4U CORP determines the purposes of processing related to its own relationship with visitors, prospective customers, and contracting customers, such as sales inquiries, account management, contracting, and billing. When a client company uses IZING to process data about its contacts and the people it communicates with, that company determines the purposes of those communications and the applicable instructions; IZING processes that data to provide the contracted service. Responsibilities are determined by the activity performed, rather than solely by the product name.
2. What data may be processed
- Sales inquiries: name, company or institution, email, phone/WhatsApp number, and an optional message. A submission may also include the product or plan of interest, language, reference currency, source, and date. These fields help organize the inquiry; they do not, by themselves, constitute tax registration or payment.
- Account and access: administrator and user identification and contact details, organizational affiliation, access profile, credentials and information required for authentication, preferences, and service settings.
- Contracting and billing: identification of the contracting customer and information needed for the proposal, contract, and transaction records. Tax identification may be requested when necessary for contracting or billing, depending on the country. These documents and bank details are not required by the sales inquiry form. The data needed at a payment stage depends on the payment method used and the information requested at that stage.
- Customer communications and integrations: identification and contact details of the people communicating, messages, audio, images, videos, documents, custom fields, tags, conversation history, and information about sending, receiving, and forwarding, depending on the channels and features used.
- AI features: messages and context excerpts, instructions, knowledge provided by the company, files submitted for reading or transcription, generated responses, and usage information, such as model, result, duration, and consumption, depending on the configuration.
- Technical data: access and operational logs, IP address, browser or device information, session identifiers, errors, and events needed for operation and security. Preferences and conversation information may also be stored in the browser, as described in section 8.
Content entered by users may contain third-party data. Provide only information that is necessary for the service and that you are authorized to process. Do not submit passwords, credentials, or sensitive personal data unnecessarily or without assessing whether the service is suitable for the intended purpose.
3. Why we use the data
Data is processed to respond to requests, prepare proposals, administer accounts and contracts, provide the requested assistance, organize conversations, run enabled integrations and AI features, provide support, maintain security, investigate failures, and comply with applicable legal obligations.
The legal basis depends on the purpose and applicable law. It may involve steps toward entering into a contract requested by the individual, performance of a contract, compliance with a legal obligation, or a legitimate interest assessed against individuals' rights. When an activity depends on consent, that consent must be requested specifically and may be withdrawn under the applicable rules. This policy is informational and does not constitute general consent to any and all processing.
For data processed on behalf of client companies, processing must follow lawful instructions and the purpose of the contracted service. The client company must inform the people it communicates with about this processing and identify the appropriate legal basis for its activities.
4. Conversations, automation, and artificial intelligence
IZING Atendimento helps organize a team's work and, when the features are included and configured, assists with writing, consults company knowledge, and provides automated customer communications. IZING Agente IA provides automated customer communications through WhatsApp associated with the customer's number. The websites may also provide a chat assistant.
To run these features, relevant conversation content, instructions, knowledge, and, depending on the feature, audio, images, or documents may be processed by the AI services used. Responses and transcriptions may form part of the service history and records. This does not mean that all content is anonymous or that processing takes place exclusively on the customer's equipment.
AI features may produce incorrect or inappropriate information. The client company must configure their use, limit the information provided, and ensure human review and handoff as appropriate to the context. Using AI in customer communications does not, by itself, authorize decisions with legal effects or significant impact on individuals without the applicable requirements and safeguards.
5. Access and sharing
Operating the services involves technical processing and authorized access for operation, support, and security, limited to what is necessary for those purposes.
Depending on the services and settings used, data may be processed by providers of hosting and storage, communications and messaging, automation, artificial intelligence, support, and administrative services related to contracting and billing. Integrations selected by the customer may also receive the data needed for the actions the customer configures. Information may be provided when required by a legal obligation or a valid order from a competent authority.
Communication platforms and other external services may operate under their own terms and policies. Customers must assess their integrations and the data they send to them. You may request information about recipients and sharing related to your data through the privacy contact.
6. Processing in other countries
Because of the location of NEXT4U CORP and the services used, data may be processed in countries other than the user's country, including outside the European Union or Brazil. The company's location alone does not waive the data protection rules applicable to the operation.
International transfers must comply with applicable requirements, including the transfer mechanism and safeguards required in each situation. Information about transfers related to your use of the service may be requested at [email protected].
7. Retention and deletion
During the relationship with IZING, retention must remain tied to the purpose of the data and the need to provide the service, fulfill the request, or comply with an applicable legal obligation. Sales inquiry data must be limited to following up on the request and the corresponding business relationship. Data that is no longer necessary for its purpose must not be retained indefinitely.
After cancellation, conversations and account data, including all backup copies, will be deleted within 30 days. Only data whose retention is required by an applicable legal obligation will be retained, for the corresponding period.
When retention is required by law, the categories of data concerned and the corresponding periods will be communicated in accordance with the applicable obligation. The period following cancellation does not replace the rules and deadlines applicable to data subject requests.
Data sent to independent services or retained by the people communicating is also subject to those recipients' responsibilities. Deletion within IZING does not amount to removing copies held by third parties outside its control.
8. Cookies and browser storage
The services may use cookies and local storage for authentication, security, language and theme preferences, and continuity of navigation. In website chats, the browser may store session identifiers, local conversation history, and assistant preferences. These records serve different functions and are not all anonymous data or advertising tools.
Usage analytics tools may be made available depending on the website configuration. The fact that a tool does not use cookies does not, by itself, mean that no data is processed.
You can manage cookies and storage through your browser settings. Removing or blocking necessary records may affect login, preferences, and conversation continuity. Deleting local history does not, by itself, delete data held on servers. When consent is required for a particular technology or purpose, processing must comply with that requirement.
9. Your rights and how to make a request
Depending on applicable law, you may request information about and access to your data, correction, deletion, portability, objection to or restriction of processing, and withdrawal of consent, where relevant. These rights may be subject to legal conditions and exceptions.
Send your request to [email protected], specifying your relationship with IZING and what you are requesting. Proportionate information may be requested to verify your identity and locate the data, without requiring unnecessary content. The request will be handled according to applicable rules and deadlines, with information about how it is being addressed and any legal limitations.
When a request concerns data processed on behalf of a client company, that company may need to participate in handling it as the party responsible for the processing purpose. Contacting IZING helps identify the appropriate way to address the request. You may also contact the competent data protection authority, where applicable.
10. Security
Processing requires technical and organizational measures proportionate to the data and risks, including access control and information protection. No service can guarantee absolute security. An incident must be assessed and addressed, with the notifications required by applicable law. This policy does not exclude responsibilities legally assigned to IZING.
Protect your credentials and report suspected misuse through the service contact. Client companies must manage their users' access and the suitability of the information entered.
11. Updates, languages, and contact
This policy may be updated to reflect changes in the services or data processing. The applicable version will be identified by its publication date. Material changes must be communicated appropriately. Publishing an update does not replace consent when it is needed or override mandatory rights.
Versions in other languages must express the same content. Translation does not constitute a legal adaptation specific to each country. If you have questions about a version, please contact us; rights granted by applicable law remain preserved.
